  • HLIVÁK, M. THE CURRENT ISSUES OF THE ARBITRATION IN THE FIELD OF THE SLOVAK FOOTBALL MOVEMENT

    The arbitration is one of the possible ways of solving the sport disputes. The author is dealing with the current issues of the arbitration in the field of Slovak football movement, such as jurisdiction of the court of arbitration, arbitration contract, arbitrability, by using the analysis of provisions of the act No. 244/2002 Coll. on Arbitration as amended in connection to the current practice of the courts of the Slovak and Czech republic. The special attention is focused on the position, jurisdiction and the procedure before the court of arbitration established by Slovak

    Football Association (SFA) after adoption of the new articles of association effective from 1.1.2013. The author is de lege ferenda suggesting the solution of the open legal issues.

  • HLIVÁK, M. Status and Legal Authority of the Arbitration Court of the Slovak Football Union

    In this article, the author deals with the definition of the status and legal authority of the Arbitration Court of the Slovak Football Union, taking into consideration the current applicable legislation of the Slovak Republic, as well as the internal regulations of the Slovak Football Union as a civic association, and those of the International Federation of Football Associations (Fédération Internationale de Football Association /FIFA/) and the Union of European Football Associations (UEFA). The objective of the article is also to point out the practical aspect of arbitration proceedings, and the application of law before the Arbitration Court of the Slovak Football Union and associated considerations de lege ferenda.
