SOUKENÍK - ŠTRPKA successfully represented the Slovak Republic - Ministry of the Environment of the Slovak Republic in a major dispute against Interblue

On 23.2.2022, the judgment of the appellate court confirming the judgment of the District Court Bratislava I in the proceedings with alleged legal successor of the company Interblue, known from the so-called emission case, which claimed against the Slovak Republic
EUR 34,643,000 together with default interest, came into effect and is final.

Both the court of first instance and the appellate court accepted the legal reasoning of the law firm SOUKENÍK - ŠTRPKA in its entirety and dismissed the action against the Slovak Republic on the ground of claimant's failure to prove its procedural legal standing. 
 
Complex legal issues, including those requiring knowledge of Swiss law, were central to the decision. Therefore, our law firm cooperated with a renowned Swiss attorney of the multinational law firm Eversheds Sutherland, Dr. Oliver Beldi. With his help, our colleagues from our law firm demonstrated to the court the expediency of the claimant's allegations and the fact that it had not plausibly established legal succession to Interblue. 
 
We are proud to have defended the position of the Slovak Republic and thus averted the threat of nearly EUR 60 million worth claim, including default interest, sought by the claimant against the Slovak Republic in this proceedings.
